A district court judge has set November 10 as the start date in the antitrust lawsuit filed by Wallace Kuralt against Barnes & Noble and Borders Group. Kuralt, owner of the now-defunct Intimate Bookshop chain in North Carolina, filed suit in summer 1998 against the large chains charging them with price discrimination that forced Intimate out of business.
As part of the proceedings, Kuralt attorney Carl Person will begin taking a deposition from Kuralt later this month. According to Person, William Pauley, U.S. district court judge for the southern district of New York, approved the request for a video deposition because Kuralt is ill with cancer.
Both chains have denied any wrongdoing and said they will defend the action.
