DOL Final Overtime Rule Delayed

A federal judge has blocked the Department of Labor from implementing and enforcing a final rule that would have raised the minimum salary required to be classified as exempt from overtime under the Fair Labor Standards Act. This means the rule has been delayed and will not go into effect on December 1, 2016. The minimum salary required for administrative, professional, and executive exemptions will remain at $455 per week pending a final decision, and the total annual compensation required for the highly-compensated employee exemption will remain at $100,000. Employers that haven’t made any changes can use this time to review their workforce under current FLSA requirements and determine what actions to take in case the rule does become effective at a later date.
