Thomas McNamara, attorney for author Nancy Stouffer, has filed a motion for reconsideration with Judge Allen Schwartz, who last month dismissed Stouffer's copyright infringement lawsuit against Scholastic and Harry Potter author J.K. Rowling. The judge also ordered Stouffer to pay $50,000 in fees and court costs.
McNamara said the motion will ask the judge to "re-examine evidence he may have overlooked" both in dismissing the suit and in issuing sanctions. Scholastic's reply is due October 15, and Judge Schwartz could issue a ruling in November. If the motion is denied, McNamara said an appeal is possible.
